You just need to be member of the EBU to participate, not necessarily a public broadcaster. I think RTL is still member of the EBU.

^^that being said, there's really a possibility that Luxembourg will come back

I read in a few places that Luxemburg intend to return to ESC in 2012 . Following the recent award Luxemburg made to Vicky Leandros - giving her the very prestigious honour and title of Commander of the Order of Merit - one idea that has been brought forward by the Broadcaster is to ask her to once again represent them at ESC .

I won't give up hoping for a Luxembourg comeback, but their opportunity was Düsseldorf and they didn't take it.
